General Terms and Conditions

General Terms and Conditions of the Online Store and Information about the Provider

The General Terms and Conditions of the SOALSA Kids online store are drawn up in accordance with the Consumer Protection Act (ZVPot-1), the Personal Data Protection Act (ZVOP), and the Electronic Communications Act (ZEKom-1).

The SOALSA Kids online store is an information system intended for the presentation and sale of products to the user. It is operated by the company Petra Design s.p., hereinafter referred to as the provider/store/SOALSA Kids.

The user is any person who uses our system, i.e., a buyer in the online store. Upon registering in the online store, the visitor obtains a username (the same as their email address) and a password, which are defined in their profile. The username and password uniquely identify the user and are linked with the provided data. After registration, the visitor becomes a user and acquires the right to make purchases.

The General Terms and Conditions govern the operation of the SOALSA Kids online store, the rights of users, and the business relationship between the provider and the customer.

Dispute Resolution

Any disputes arising from the use of the SOALSA Kids online store, the General Terms and Conditions, or purchases made shall be resolved by the District Court in Maribor (Okrožno sodišče v Mariboru), Sodna ulica 14, Maribor, Slovenia, which has jurisdiction in such matters.

The buyer is bound by the general terms and conditions that are valid at the time of purchase (submission of an online order). The user is reminded of the general terms and conditions each time an order is placed, and by submitting an order, the user confirms their awareness and acceptance of them.

Availability of Information

The provider will always ensure that the consumer (buyer) receives the following information:

  • the main characteristics of the goods or digital content, to the extent appropriate to the medium and the goods or digital content;
  • the company name, registered office address, and telephone number of the company;
  • the final price of the goods or digital content, including taxes, or the method of calculating the price if, due to the nature of the goods, services, or digital content, it cannot be calculated in advance;
  • information on any additional transport, delivery, or shipping costs, or a warning that such costs may be incurred if they cannot be reasonably calculated in advance;
  • payment terms and conditions for the delivery of goods and the performance of services or the supply of digital content, including the delivery period of goods and the performance of services or the supply of digital content, where necessary;
  • information about the company’s complaint procedure;
  • information on the statutory warranty for the conformity of goods or digital content;
  • information on the possibility and conditions of after-sales services and voluntary guarantees (commercial warranties), where necessary;
  • the duration of the contract, where applicable, and the conditions for withdrawal from the contract.

1.1 Order Processing and Fulfillment:
The personal data you provide is used to process your orders, purchases, and deliveries to your chosen delivery address. This includes communicating with you about the status of your order and providing necessary updates.

1.2 Customer Support:
We may use your personal data to respond to your inquiries, provide customer support, and resolve any issues you may have with our products or services.

1.3 Marketing Communication:
With your consent, we may send you promotional emails or newsletters about our products, special offers, abandoned carts, or upcoming events. You may unsubscribe from receiving such communications at any time by following the unsubscribe instructions in the emails or by contacting us directly.

Ordering is available online 24/7, all year round. The consumer selects and orders products available in the online store, organized by categories.

Ordering in our online store is safe and simple.

You can complete a purchase in the SOALSA Kids store in five steps:

  1. select the product(s) and add them to the cart,
  2. review your shopping cart,
  3. enter your billing and shipping details,
  4. choose the delivery and payment method, and
  5. confirm the order.
    The selected goods are then delivered to the chosen address as soon as possible.

Order Confirmation and Changes

After submitting the order, the customer receives an email confirmation that the order has been received. The email lists the selected products and quantities.

For any changes or cancellations, the customer must notify the provider by email at info@soalsakids.com and include the order number stated in the purchase confirmation email.

Product Characteristics

Product photos are symbolic and do not guarantee the exact characteristics of the products (particularly regarding possible color deviations). The provider does not assume responsibility for the accuracy and completeness of the information on the online store pages (including textual or visual material).

After Placing an Order

SOALSA Kids (Petra Design s.p.) reserves the right to reject an order if the item is no longer in stock or in cases of obvious pricing errors, which may occur due to automated transfer issues. In such cases, we will notify you as soon as possible. In case of uncertainties, data verification, or to ensure proper delivery, we may contact you by phone using the number provided when placing the order.

The goods will be prepared within the agreed timeframe and shipped to your address. You will be informed by email once your order is completed. If you ordered products that cannot be delivered within the promised timeframe due to unforeseen reasons, you will be notified of the new delivery time by phone or email.

Customers may also receive regular email updates about the delivery status of their items. If the delivery time is significantly extended and the customer does not wish to wait, they may notify us at info@soalsakids.com or by phone to remove the item from the order. Petra Design s.p. will refund any payments already made for the unavailable item. For the remaining products, the customer can choose whether to proceed with delivery or cancel the entire order. If the supplier does not confirm availability of the ordered items within two weeks of the order date, Petra Design s.p. may reject the order due to unavailability. Upon rejection, the customer’s order is void. Petra Design s.p. does not assume liability for damages caused by longer delivery times or failure to deliver products not in stock, except where caused intentionally or by negligence.

In the agreed timeframe, Petra Design s.p. will prepare the item, ship it, or make it available for personal pickup, and will notify the customer by email or SMS. The email will also include information about the right of withdrawal, instructions for late deliveries, and complaint procedures. SMS notifications from the courier (GLS or Post of Slovenia) are not received by SOALSA Kids, so customers are kindly asked not to reply to such SMS messages, but instead to contact us directly via email or phone.

If the customer decides to cancel the order in time, they must notify the seller immediately by calling +386 70 480 443 or emailing info@soalsakids.com. If the order has already been dispatched, the customer must refuse the shipment upon delivery.

The sales contract between the provider and the customer is concluded once the provider confirms the order. From this moment, all prices and other conditions are fixed and binding for both parties. Prices remain valid until changed and may be adjusted without prior notice. If the price of an item changes during order processing, the provider will notify the customer. We will do our best to honor the lower price or offer an appropriate solution to ensure mutual satisfaction. Otherwise, Petra Design s.p. reserves the right to withdraw from the contract and refund the customer’s payment.

The sales contract (i.e., the first email confirmation of order status) is stored electronically on the SOALSA Kids server and is available to the customer upon request. Contracts on www.soalsakids.com are concluded exclusively in the Slovenian language.

Petra Design s.p. is not liable for potential errors (grammatical, typographical, or other). In the event of errors, the customer will be notified.

Care Instructions

Cotton Products

  • Wash at 30°C with similar colors.
  • Use a gentle detergent without bleach.
  • Avoid tumble drying – air drying is recommended to preserve shape and softness.
  • Iron at medium temperature if necessary.

Muslin Cotton

  • Wash at 30°C on a gentle cycle.
  • Do not use bleach or strong detergents, as muslin is a delicate fabric.
  • Air dry flat or hang to dry; tumble drying may cause shrinkage.
  • Iron on low heat if needed, though muslin naturally has a soft, crinkled texture.

Knitted Cotton

  • Wash at 30°C on a gentle cycle, preferably in a laundry bag to prevent stretching.
  • Reshape while damp and dry flat on a clean towel to maintain form.
  • Do not wring or twist to avoid damaging the knit.
  • Avoid tumble drying – it can cause shrinkage and damage to the knit.
  • Ironing is generally not necessary; if needed, use low heat and place a cloth over the knit.

Invoicing

After the delivery of the ordered items, SOALSA Kids (Petra Design s.p.) will send the customer an invoice to the provided email address.

The invoice includes a detailed breakdown of the price and all costs related to the purchase, along with information about the customer’s right of withdrawal from the contract.

The invoice is issued in electronic form and is considered legally equivalent to a paper invoice.

The customer is obliged to check the accuracy of the information before submitting the order. Later objections regarding the correctness of the issued invoices will not be considered.

Prices

All prices on the website are listed in euros (EUR) and include VAT, unless explicitly stated otherwise on the website.

A discounted price represents the reduced regular price at which the product is offered for a specific or indefinite period of time.

All prices in the online store apply to the products only and do not include delivery costs.

Prices are valid at the time the order is placed and do not have predetermined validity. Prices apply if payment is made using the listed payment methods and under the specified conditions.

Credit and Debit Cards

When paying by credit or debit card, the following conditions apply:

  • The payer (the details provided in the customer account or on the invoice) must be the same person or organization as the cardholder.
  • If the payer’s details on the account and the credit/debit card holder’s details do not match, the provider reserves the right to cancel the order.
  • After the order has been confirmed and payment has been received, changes to the order content or the final order amount are not possible, except in exceptional cases with the provider’s approval.

Discount Codes

A discount or promotional code provides various benefits when shopping in the SOALSA Kids online store. Active codes can be found on the homepage, in promotional emails from SOALSA Kids, or in other media. Discount codes may grant different benefits, from gifts to discounts.

Each code is always time-limited and must be redeemed within the specified period; otherwise, it becomes invalid. If the customer redeems a discount code but later cancels the order voluntarily, they are no longer entitled to a new benefit under the same code.

Discount codes cannot be combined and do not apply to products already on sale, unless stated otherwise.

Discount codes do not apply to gift cards.

How to Use a Discount Code

  1. Select the items you wish to purchase and add them to your cart.
  2. When finished, proceed to checkout.
  3. Enter your personal details, select the delivery method, provide the delivery address, and choose the payment method.
  4. In the same step, click on the field “Have a coupon? Click here to enter your code”. Enter the discount code in the coupon field and confirm by clicking Apply coupon.
  5. The value of the discount will automatically be deducted from your order total. The remaining balance is the amount to be paid.

A discount code may also be a single-use code, which can only be redeemed once.
Combining different forms of benefits (discount code, promotional code, bonus) within the same order is generally not possible.

Delivery

Our contractual delivery partner for shipments within Slovenia and abroad is GLS. However, SOALSA Kids (Petra Design s.p.) reserves the right to choose another delivery service if this ensures faster or more efficient fulfillment of the order.

Product Availability

All products in the SOALSA Kids online store display information about their availability. Availability data applies to business days only.

In rare cases, discrepancies in stock information may occur due to simultaneous purchases, system errors, or delays in updating availability.

If a product is shown as available but is, in fact, out of stock, SOALSA Kids (Petra Design s.p.) will notify the customer as soon as possible by email or phone. The customer may then choose one of the following options:

  • replacement with another product of equal value,
  • waiting until the product becomes available again, or
  • cancellation of the order and a full refund of the purchase price.

Order Cancellation

A placed order may be canceled free of charge until the buyer receives the “Order dispatched” email.
Cancellation is only possible by emailing info@soalsakids.com.

When requesting a cancellation, the customer must provide:

  • Order number
  • Buyer’s full name
  • Buyer’s address

If items from the order cannot be supplied and the customer does not respond to our notification, SOALSA Kids (Petra Design s.p.) reserves the right to cancel the order. Before doing so, we will notify the customer by email and/or call the phone number provided with the order. If the customer does not respond within ten (10) business days, the provider may cancel the order.

For orders paid in advance (e.g., card payment, or other enabled methods), refunds will be issued within five (5) business days of the cancellation. The refund is processed using the original payment method whenever possible.

Withdrawal from the Contract – Returns

In accordance with the Consumer Protection Act (ZVPot-1), the consumer has the right to withdraw from the contract within 14 days without stating any reason.

The consumer may notify SOALSA Kids (Petra Design s.p.) of withdrawal by completing the withdrawal form or by sending a written, unambiguous statement of withdrawal.

The burden of proof for exercising the right of withdrawal lies with the consumer.

If the consumer has already received the goods and withdraws from the contract, the goods must be returned to the company (or a person authorized by the company) without undue delay and no later than 14 days from the notice of withdrawal. In such cases, the provider will refund all payments received for the order within 14 days of receiving the returned goods, using the same means of payment used by the consumer unless expressly agreed otherwise. Cash refunds are not made.

For sales contracts, the company may withhold the refund until the returned goods are received or until the consumer provides proof that the goods have been sent back, unless the company offers to collect the goods itself.

For hygiene reasons, returns are not accepted for opened underwear, covers, or protective masks.

In the event of withdrawal, the consumer bears only the direct cost of returning the goods.

The right of withdrawal applies only to consumers (natural persons purchasing outside their trade, business, or profession) and does not apply to legal entities.

The consumer is liable for any diminished value of the goods resulting from handling beyond what is necessary to determine their nature, characteristics, and functioning. This liability may amount up to the product’s full retail value. We therefore recommend returning goods undamaged, unused, in the original quantity and condition, with original packaging and tags attached. Clothing should be tried on over other garments, not on bare skin, and care should be taken to avoid make-up or powder marks.

The provider cannot deny the right of withdrawal solely because of diminished value caused by the consumer’s necessary inspection of the goods.

Partial Withdrawal & Promotional Discounts

In case of partial withdrawal (returning only some items), any promotional discounts applied per item in the cart (e.g., “3 for 2”, discount on the third item) will be recalculated proportionally across all items. The refund will reflect the adjusted value of the returned product(s).

The company is not responsible for refund delays caused by banks or online payment providers.

Exceptions to the Right of Withdrawal (Art. 135 ZVPot-1)

Unless otherwise agreed, the consumer has no right of withdrawal for:

  • goods made to the consumer’s specifications or clearly personalized;
  • perishable goods or goods with a short shelf life;
  • sealed goods not suitable for return for health or hygiene reasons if unsealed after delivery;
  • goods which, by their nature, are inseparably mixed with other items;
  • gift cards, which are transferable value documents and are non-refundable;
  • products purchased on sale or promotion (discounted items are final sale and cannot be returned).

Non-Conformity of Goods (Defects)

If the goods are not in conformity with the contract, the consumer who notified the seller of non-conformity is entitled to:

  1. free repair or replacement,
  2. proportional price reduction, or
  3. withdrawal from the sales contract and a refund.

The consumer may withhold payment (in whole or in part) until the seller fulfills these obligations and may claim compensation for costs (materials, spare parts, labor, transport) arising from asserting these rights.

The seller must restore conformity within a reasonable period from notification, no longer than 30 days; this may be extended by up to 15 days where necessary (considering the nature/complexity of the goods and the defect). The seller must notify the consumer of any extension before the original period expires.

The consumer may choose between repair and replacement, unless impossible or disproportionate for the seller considering all circumstances (value of the goods if conform, significance of the non-conformity, and whether another remedy can be provided without significant inconvenience). Where replacement is needed, the seller bears the costs and takes back the replaced goods at its own expense, including removal/re-installation where applicable. The consumer does not owe payment for normal use of the replaced goods prior to replacement.

The consumer cannot withdraw if the non-conformity is minor (the burden of proof lies with the seller).

Notice of Non-Conformity & Inspection

  • The consumer must notify the seller of the non-conformity within two months from the day it was discovered and describe it precisely.
  • The consumer must allow the seller to inspect the goods claimed to be non-conforming.

Promotional Bundles (1+1, 2+1, etc.)

For items purchased as part of a promotional bundle (e.g., “1+1 free” or “2+1 free”), all items from the promotion must be returned together, since the contract applies to the entire bundle. Refunds are granted only if all promotional items are returned.

Discounted Products & Brand Note

  • Sale/discounted items are final sale and cannot be returned.
  • Products sold at a reduced price due to lower quality or minor defects and clearly disclosed as such (in the product description, at checkout, or via a brand note in the package) cannot be complained about for the specified defect/reason for the reduced price.
  • The consumer keeps the right to complain about other defects that were not disclosed at purchase.

Damaged, Destroyed, or Lost Shipment

For prepaid orders, once the parcel with the ordered items is handed over to the courier, SOALSA Kids (Petra Design s.p.) is not liable for cases of physical damage, destruction, loss of the shipment, missing contents, or if the parcel shows signs of tampering (e.g., visibly damaged packaging).

In all such cases, the customer must initiate a complaint with the courier (e.g., GLS or Pošta Slovenije) as follows:

  1. Take the parcel to the nearest courier office (GLS or Pošta Slovenije) in the same condition as received, without adding or removing anything.
  2. File a damage/loss report (reklamacijski zapisnik / damage claim form) on the spot.
  3. Notify SOALSA Kids about the issue by email at info@soalsakids.com, attaching the claim confirmation and any supporting photos.

We will cooperate with the courier to help resolve the claim as quickly as possible.

Warranty Claims (Legal Guarantee of Conformity)

In case of non-conformity of goods, the consumer who has notified the seller of such non-conformity is entitled, under the conditions and in the order set by law, to:

  1. request the free restoration of conformity (repair or replacement) of the goods;
  2. request a proportional reduction of the purchase price or withdraw from the sales contract and request a refund.

The consumer may withhold payment of the remaining purchase price (in whole or in part) until the seller fulfills these obligations. This right is exercised by notifying the seller of the decision in writing.

In all cases, the consumer also has the right to claim compensation for damages, including costs of materials, spare parts, labor, transport, and shipping, that arise due to the exercise of warranty rights.

Restoration of Conformity

The consumer may request that the seller restore the conformity of the goods within a reasonable time, not exceeding 30 days from the notification of non-conformity, without significant inconvenience for the consumer, taking into account the nature of the goods and the purpose for which the consumer needs them.

This period may be extended by up to 15 additional days where necessary, considering the nature and complexity of the goods and the severity of the defect. The seller must inform the consumer of the extension and the reasons before the original deadline expires.

Restoration of conformity is free of charge, and the seller covers all necessary costs, including shipping, transport, labor, and materials.

The consumer may choose between repair and replacement, unless the chosen remedy is impossible or would impose disproportionate costs on the seller compared to the alternative, taking into account all circumstances (value of the goods, significance of the non-conformity, and possibility of another remedy without significant inconvenience).

The seller may refuse the consumer’s request if both repair and replacement are impossible or would impose disproportionate costs.

Where repair or replacement is necessary, the consumer must make the goods available to the seller. In case of replacement, the seller bears all related costs and takes back the replaced goods at its own expense.

If the goods had to be installed before the defect was discovered, the seller is also responsible for removing the non-conforming goods and installing the replacement or repaired goods, or for covering the costs of removal and re-installation.

The consumer does not have to pay for the normal use of the replaced goods during the period before their replacement.

Price Reduction and Contract Withdrawal

The consumer may request a proportional reduction of the purchase price or withdraw from the contract in the following cases:

  • the seller has not repaired or replaced the goods, or has refused to do so, within the legal timeframe;
  • the non-conformity persists despite the seller’s attempt to restore conformity;
  • the non-conformity is of such a serious nature that it justifies immediate withdrawal from the contract or price reduction;
  • the seller has stated, or it is clear from the circumstances, that conformity will not be restored within a reasonable time or without significant inconvenience to the consumer.

If the non-conformity appears within 30 days of delivery, the consumer may immediately withdraw from the contract and request a refund.

Price reduction must be proportional to the reduced value of the goods received compared to the value the goods would have had if conforming.

The consumer exercises the right of withdrawal by sending a written statement notifying the seller of the decision.

If the non-conformity concerns only part of the goods delivered, the consumer may withdraw from the contract only in respect of those goods, unless it is unreasonable to expect the consumer to keep only the conforming goods.

When withdrawing, the consumer must return the goods at the seller’s expense.

The consumer cannot withdraw from the contract if the non-conformity is minor. The burden of proof that the defect is minor lies with the seller.

Notification of Non-Conformity and Inspection

The consumer must notify the seller of the non-conformity within two months of discovering it and provide a precise description.

The notification can be given in person (with confirmation issued by the seller), by sending it to the shop where the goods were purchased, or to the seller’s representative with whom the contract was concluded.

The consumer must allow the seller to inspect the goods that are claimed to be non-conforming.

Customer Responsibility

The customer is obliged to check the accuracy of the information on the invoice and notify the seller of any errors within eight (8) days of receipt. Later complaints regarding invoice data will not be accepted.

Your credit card will be charged directly upon confirmation of your order. The amount charged to your card may differ from the amount shown on our website, as it depends on surcharges or fees applied by your card issuer and/or payment provider during the transaction process.

We are not responsible for any fees related to fluctuating exchange rates, additional charges imposed by your bank, or any other transaction fees applied by your card issuer for foreign currency transactions, in cases where EUR is not the billing currency of your credit card account.

Data Protection

SOALSA Kids (Petra Design s.p.) is committed to the permanent protection of all personal data of its users, in accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 (GDPR)and the Slovenian ZVOP-1.

The user must provide their personal data to the online store in a correct and truthful form and is also obliged to notify the store of any changes to this information.

By accepting these Terms & Conditions, the user confirms that the personal data provided is accurate and up to date.

Communication

SOALSA Kids (Petra Design s.p.) will contact the user via remote communication methods only if the user does not explicitly object, and always in accordance with the provisions of the Electronic Communications Act (ZEKom-1).

Promotional emails sent by the provider will include the following:

  • They will be clearly and unambiguously marked as promotional messages.
  • The sender SOALSA Kids (Petra Design s.p.) will be clearly identifiable.
  • Campaigns, promotions, and other marketing techniques will be clearly marked as such, with the conditions of participation clearly stated.
  • The method of unsubscribing from promotional messages will be clearly explained.
  • The provider will explicitly respect the user’s wish to stop receiving promotional messages.
  • Promotional messages from SOALSA Kids will be clearly distinguishable from games and competitions.

The online store SOALSA Kids is the property of Petra Design s.p. and all rights are reserved.
The website content may also include material subject to third-party copyright. Any distribution of information or materials from these websites is permitted only with prior written approval from the owner.

The provider reserves the right to change these Terms & Conditions at any time without prior notice.

Limitation of Liability

SOALSA Kids (Petra Design s.p.) strives to ensure that the information published on its website is up-to-date and accurate. However, product features, delivery times, or prices may change so quickly that the provider cannot update the information in time.

In such cases, the provider will notify the customer of the changes and allow them to withdraw from the contract or replace the ordered product.

The provider may withdraw from the contract only if an obvious error (46. Article of the Obligations Code) is identified. An obvious error includes essential product characteristics or any mistake considered decisive in business practice or by customer intent, which the provider would not have confirmed had it been aware of it. This also includes obvious pricing errors.

Complaints and Disputes

The complaint handling process is confidential.

SOALSA Kids is aware that the key characteristic of consumer disputes is the disproportion between the economic value of the claim and the time and costs required to resolve the dispute, which often discourages consumers from bringing the matter before a court. Therefore, the company will make every effort to resolve potential disputes amicably and out of court.

The provider will confirm receipt of a complaint within five (5) working days, inform the user of the expected processing time, and keep the user regularly updated on the progress of the procedure.

These Terms & Conditions are governed by the laws of the Republic of Slovenia.

Any disputes arising out of or in connection with these Terms & Conditions, purchases, or the use of the SOALSA Kids online store shall primarily be resolved amicably. If an amicable resolution is not possible, the dispute shall be subject to the exclusive jurisdiction of the District Court in Maribor (Okrožno sodišče v Mariboru), Sodna ulica 14, 2000 Maribor, Slovenia.

Out-of-Court Consumer Dispute Resolution

In accordance with applicable legislation, Petra Design s.p. does not recognize any provider of out-of-court consumer dispute resolution as competent for resolving a consumer dispute that a consumer may initiate under the Act on Out-of-Court Settlement of Consumer Disputes.

As a provider enabling online sales in the Republic of Slovenia, SOALSA Kids (Petra Design s.p.) publishes on its website an electronic link to the European Commission’s Online Dispute Resolution (ODR) platform for consumer disputes resolved online.

This arrangement follows the Act on Out-of-Court Settlement of Consumer DisputesRegulation (EU) No 524/2013on online dispute resolution for consumer disputes, and related amendments to Regulation (EC) No 2016/2004 and Directive 2009/22/EC.

How can I return items?

If you wish to return a product, please follow these steps:

  1. Prepare the item(s) for returnEnsure that the products are in their original condition: unworn, unwashed, with original packaging and tags attached.

How long do I have to return my package?

You have 14 days from the date of receipt to return your package.

Can I exchange an item?

Exchanges are possible for the same product in a different size or color.

  • Please indicate your exchange request clearly on the Return Form.
  • Exchanges for completely different products are not possible.

Your exchange will be processed within 2–5 business days of receiving your returned item.
The exchange will be made at the same purchase price as the original item.

Are all items returnable?

Not all items in our store can be returned.

No, I don’t sew the products myself. They are produced in a verified factory outside the EU, which we carefully selected as our trusted partner.

Where are the products designed?
All products are designed in Slovenia by SOALSA Kids, with the support of professional designers from the factory.

We choose not to throw these items away, because they are still safe, wearable, and comfortable – even if they are not perfect by our standards. As we are still in the early stages of our journey, we are learning and improving with every collection. 💛
